Welcome to www.kamtush.com, operated by Kamtush ("we", "our", "us"). By accessing our website, placing an order, or using our services online or at our store, you agree to these Terms & Conditions. Please read them before purchasing.

1. Eligibility

You must be 18 years or older and capable of entering a legally binding contract under Indian law to purchase from us.

2. Products & Pricing

• All products sold by Kamtush are genuine and sourced through authorized channels.
• Prices are listed in Indian Rupees (INR) and are inclusive of GST unless stated otherwise.
• Prices, offers, and availability may change without prior notice. The price applicable is the one displayed at the time of order confirmation.
• In case of a pricing or listing error, we reserve the right to cancel the order and issue a full refund of any amount paid.

3. Orders & Acceptance

• Placing an order constitutes an offer to purchase. An order is confirmed only after payment authorization and our order confirmation via SMS, email, or WhatsApp.
• We reserve the right to refuse or cancel any order due to stock unavailability, pricing errors, suspected fraud, or serviceability limitations. Any amount paid for a cancelled order will be refunded in full.

4. Payments

• Payments are processed through secure, PCI-compliant third-party payment gateways. Kamtush does not store your card, UPI, or banking credentials.
• Cash on Delivery, where offered, is subject to order value limits and serviceable locations.

5. Delivery & Installation

• Delivery timelines shown at checkout are estimates and may vary due to location, stock, or logistics conditions.
• Doorstep delivery and professional installation are provided in serviceable areas as described on our Delivery & Installation page.
• Customers must provide accurate address and contact details. Failed deliveries due to incorrect information may attract re-delivery charges.
• Installation includes setup, connection, and testing of the purchased product. Additional civil, electrical, or wiring work beyond standard installation, if required, may be chargeable and will be communicated before work begins.

6. Warranty

• All products carry the official manufacturer warranty. Warranty terms, duration, and claim procedures are governed by the respective brand (Amaron, Exide, Luminous, Microtek, or others as applicable).
• Warranty claims are serviced through the brand's authorized service network. Kamtush will assist and guide you through the claim process but does not itself replace or repair products under manufacturer warranty unless authorized to do so.
• Warranty may be void in cases of physical damage, tampering, improper use, unauthorized repairs, or installation not performed as per manufacturer guidelines.
• Customers are advised to retain the invoice and warranty card for all claims.

7. Returns, Refunds & Cancellations

Returns, refunds, and cancellations are governed by our Return & Refund Policy published on this website. Products that have been installed, used, or filled with electrolyte are not eligible for return except in cases of verified manufacturing defects, which are handled under manufacturer warranty.

8. Old Battery Exchange

Where an exchange offer is availed, the exchange value is determined at the time of delivery based on the old battery's type and condition. Kamtush reserves the right to revise or refuse exchange value if the battery does not match the details provided at the time of order.

9. B2B & Bulk Orders

Bulk and business orders are subject to separate commercial terms, including pricing, delivery schedules, and payment terms, agreed upon in writing or via confirmed quotation. GST invoices are provided for all business purchases.

10. Website Use & Intellectual Property

• All content on this website, including text, images, logos, and design, is the property of Kamtush or its licensors and may not be copied or reused without written permission.
• Product images are for representation. Actual products may vary slightly in appearance without affecting specifications.
• You agree not to misuse the website, attempt unauthorized access, or engage in any activity that disrupts its functioning.

11. Limitation of Liability

To the maximum extent permitted by law, Kamtush's liability for any claim arising from a purchase is limited to the amount paid for the product in question. We are not liable for indirect or consequential losses, including power loss, data loss, or business interruption arising from product failure. Nothing in these terms limits your statutory rights under the Consumer Protection Act, 2019.

12. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, transport disruptions, or government restrictions.

13. Privacy

Use of our website is also governed by our Privacy Policy, which explains how we collect and protect your personal data.

14. Governing Law & Jurisdiction

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi.

15. Changes to These Terms

We may update these Terms & Conditions periodically. Continued use of the website after changes are posted constitutes acceptance of the revised terms.
